Taking Disciplinary, Adverse and Performance-Based Actions

This 2-day course is designed to give supervisors, managers, administrative and personnel staff a basic understanding of the processes used in taking disciplinary, adverse and performance-based actions. It takes the participant from the beginning of a disciplinary situation to the appeal, covering all aspects of disciplinary and adverse actions. It also takes participants through all of the procedures and case law regarding taking performance-based actions.

The session first focuses on the legal, regulatory, procedural and other requirements which must be met when taking disciplinary and adverse actions. It then discusses how to investigate misconduct and how to compile a case file. The session next outlines factors which must be considered in determining the merits of a case, and discusses how to properly frame a charge and choose a supportable penalty. It discusses special measures to be taken in leave abuse cases. The session then covers the procedures and requirements for taking Unacceptable Performance Actions, and the difference between these actions and disciplinary and adverse actions. Grievance and appeal rights are also covered, including employee rights to representation. And finally, reasonable accommodation in discipline and adverse action cases, including drug and alcohol cases, is discussed and procedures for termination of probationary employees for conduct-related reasons are covered.
